The Uttar Pradesh Public Service Commission (UPPSC) is expected to release notifications for the post of Drug Inspector. A major area of confusion for pharmacy graduates is the “Experience Requirement”. Following recent historic judgments by the Supreme Court of India and various High Courts, the eligibility landscape has changed significantly in favor of fresh graduates.

Below is a detailed analysis of the legal rulings that confirm fresh B.Pharm/Pharm.D graduates may be eligible, as the “18-month experience” clause has been repeatedly termed as a post-appointment requirement or “Ultra Vires” (beyond legal power) when added arbitrarily.

1. Important Legal Judgments (Freshers vs. Experience)

Several High Courts have ruled that the experience mentioned in the Drugs and Cosmetics Rules is often misunderstood. Here is the in-depth breakdown of the latest verdicts:

Supreme Court of India: UPSC v. Shristi Singh (2021)

Verdict: The Supreme Court dismissed the appeal by UPSC, effectively upholding the Delhi High Court’s decision.

  • The Court refused to disturb the finding that UPSC could not insist on prior experience for Drug Inspector posts.
  • It validated that the experience clause in Rule 49 is for authorizing inspections after appointment, not a pre-condition for initial eligibility.
  • The added requirement of “18 months experience” in the advertisement was found legally untenable.
Patna High Court: Soumya Bharadwaj v. State of Bihar (July 11, 2024)

Verdict: Ruling in favor of Freshers.

  • The Division Bench clarified that the Drug Inspector notification need not include any experience clause.
  • The court upheld the BPSC’s notice (dated 23.05.2023) which waived Rule 49 experience conditions.
  • Observation: “Experience as contained in proviso to Rule 49 is not a mandatory requirement for being appointed as Drug Inspector.”

Karnataka High Court: Mahesh N. S. v. State of Karnataka (March 31, 2023)

  • Justices Sistani and Bhambhani ruled that a candidate’s experience certificate post-dating the test was invalid, but more importantly, distinguished pre-appointment qualifications from post-appointment duties.
  • Key Ruling: Rule 49’s proviso is for authorizing inspections after appointment.
  • Adding an 18-month experience criterion without parliamentary approval effectively amended statutory rules, which is impermissible.

2. UPPSC Drug Inspector Expected Eligibility

Based on the Central Drugs and Cosmetics Rules, 1945 and the recent judgments mentioned above, the expected eligibility for UPPSC Drug Inspector is as follows:

(Pharm.D candidates are also eligible as per Pharmacy Act).

Age Limit Minimum: 21 Years
Maximum: 40 Years (Age relaxation applicable for UP Domicile SC/ST/OBC).

3. UPPSC Drug Inspector Exam Pattern

The selection process generally consists of a Written Examination followed by an Interview. The written exam typically includes two papers.
